1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or when you otherwise contact us.

Personal Information Provided by You. The personal information that we collect depends on how you interact with us, the choices you make, and the products and features you use. The personal information we collect may include the following:

Sensitive Information. We do not process sensitive information.

Payment Data. If you make purchases, your payment information (such as credit card numbers) is collected and processed directly by our third-party payment processors. We do not collect, store, or have access to your full payment card details. We use the following payment processors:

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies. The information we collect includes:

Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports, and hardware settings).

Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Location Data. We may derive approximate location information from your IP address (such as your city or region). We do not collect precise geolocation data (such as GPS coordinates).

Information collected from other sources

In Short: We may collect limited data from public databases and other outside sources.

In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as publicly available databases and social media platforms. This information may include contact details such as email addresses and professional information such as job titles, for purposes of communicating with you about our services.

In Short: We process your personal information only when we have a valid legal reason to do so, such as your consent, to fulfill our contractual obligations, to comply with law, or to pursue our legitimate business interests.

We rely on the following legal bases to process your personal information:

  • Consent: You have given us permission to use your personal information for a specific purpose. Where we rely on consent, you may withdraw it at any time.
  • Contractual Necessity: Processing is necessary to provide you with our Services or to fulfill our obligations under an agreement with you.
  • Legal Obligations: We are required to process your information to comply with applicable laws.
  • Legitimate Business Interests: Processing is necessary for our legitimate business interests (such as improving our Services, internal analytics, and business development), provided those interests are not overridden by your rights.

Canadian Residents: Under PIPEDA and applicable provincial privacy legislation (including Quebec's Law 25), we may process your information with your express or implied consent, depending on the circumstances. In some exceptional cases, we may be legally permitted to process your information without consent, such as for fraud detection and prevention, to comply with a subpoena or court order, or where collection is clearly in the interests of an individual and consent cannot be obtained in a timely way.

  • Service Providers. We may share your information with third-party service providers who perform services on our behalf, such as payment processing (HubSpot, Stripe), hosting, analytics, and email delivery. These providers are contractually obligated to use your information only as necessary to provide services to us.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We take commercially reasonable steps to protect your personal information, but no method of transmission or storage is 100% secure.

We take commercially reasonable steps to protect the personal information we process, including the use of third-party service providers (such as HubSpot and Stripe) that maintain their own security programs. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot guarantee that unauthorized third parties will not be able to access your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 13 years of age.

We do not knowingly solicit data from or market to children under 13 years of age, in accordance with the Children's Online Privacy Protection Act (COPPA). Our Services are available to users aged 13 and older. If you are between 13 and 18 years of age, you may use the Services with the consent of a parent or guardian. If we learn that personal information from a child under 13 has been collected without verifiable parental consent, we will take reasonable measures to promptly delete such data from our records. 9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on where you are located, applicable privacy laws may grant you certain rights regarding your personal information. You may review, change, or terminate your account at any time.

In some regions (like Canada and certain U.S. states), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) to request correction of inaccurate personal data. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

We will consider and act upon any request in accordance with applicable data protection laws.

Canadian Residents: If you are located in Canada, you have additional rights under PIPEDA and applicable provincial privacy legislation. These include the right to access your personal information held by us, the right to challenge the accuracy and completeness of your information and have it amended, and the right to withdraw consent (subject to legal or contractual restrictions). You may file a complaint with the Office of the Privacy Commissioner of Canada (https://www.priv.gc.ca) if you believe we have handled your personal information improperly.

Quebec Residents: If you reside in Quebec, additional protections apply under Law 25. You have the right to data portability (receiving a copy of your personal information in a commonly used format), the right to be informed of automated decision-making, and the right to request de-indexing of your personal information from search results. You may file a complaint with the Commission d'accès à l'information du Québec.

Breach Notification (Canada): In the event of a breach of security safeguards involving your personal information that creates a real risk of significant harm, we will notify the Office of the Privacy Commissioner of Canada and affected individuals as required under PIPEDA.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

Global Privacy Control (GPC): We do not sell or share personal information as those terms are defined under applicable privacy laws. If we begin to engage in such activities in the future, we will honor the Global Privacy Control (GPC) signal as a valid opt-out request, as required by applicable law.

11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of certain U.S. states, you may be granted specific rights regarding access to your personal information.

Several U.S. states have enacted comprehensive privacy laws that grant residents specific rights regarding their personal information. These states include, but may not be limited to, California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others. If you are a resident of one of these states, you generally have the rights to access, correct, and delete your personal information; to obtain a portable copy of your data; and to opt out of the sale of personal information, targeted advertising, and certain profiling activities. The specific details of these rights vary by state. California residents have additional specific rights described below, followed by information for residents of other states.

California Residents

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA/CPRA Privacy Notice

The California Code of Regulations defines a "resident" as: (1) every individual who is in the State of California for other than a temporary or transitory purpose and (2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. All other individuals are defined as "non-residents."

If you are using an authorized agent to exercise your right to opt out we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

The Human Stack has not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. The Human Stack will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

Your rights with respect to your personal data

Right to request deletion of the data — Request to delete: You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law.

Right to be informed — Request to know: Depending on the circumstances, you have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell or share your personal information to third parties;
  • the categories of personal information that we sold, shared, or disclosed for a business purpose;
  • the categories of third parties to whom the personal information was sold, shared, or disclosed for a business purpose; and
  • the business or commercial purpose for collecting, selling, or sharing personal information.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to correct inaccurate personal information: You have the right to request that we correct any inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes of the processing.

Right to limit use of sensitive personal information: We do not collect sensitive personal information as defined under the CPRA.

Right to opt out of sale or sharing: You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising purposes. We do not currently sell or share personal information as defined under the CPRA.

Right to Non-Discrimination for the Exercise of a Consumer's Privacy Rights: We will not discriminate against you if you exercise your privacy rights.

Verification process: Upon receiving your request, we will need to verify your identity before fulfilling it. We may ask you to confirm information you have previously provided to us. Any additional information collected solely for verification purposes will be deleted once verification is complete.

Other privacy rights:

  • You may object to the processing of your personal information.
  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
  • You can designate an authorized agent to make a request under the CCPA on your behalf.
  • You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.
